If you have been diagnosed with cancer you may be eligible for Social Security Disability Benefits. Most types of cancer are covered under the Social Security Administration definitions for disability. If you are unable to work due to a recent diagnoses of cancer you can call our office toll free at (860) WIN – RAMOS for more information about how we can help you get benefits.
As part of your application, you will need your doctor to provide documentation of the type of cancer that you have. In addition, you may want to check with your doctor to make sure that he or she will support your application for Social Security Disability Benefits.
In a very small number of cases, the Social Security Administration approves benefits for cancer patients early in the process. Unfortunately, it’s a difficult claim to make. Many patients are treated and return to good health within a year. Furthermore, cancer may not prevent a person from performing many routine tasks required in most jobs (walking, standing, sitting, lifting, speaking, hearing, etc.).
Social Security uses the Listings of Impairments manual as their “blue book” guide to determine whether a claimant meets or does not meet the Social Security Administration’s requirements for total disability. In its impairment listing manual, the Social Security Administration considers certain types of cancer under the category of “malignant neoplastic diseases.” These are malignant cancers such as lung cancer, leukemia, brain tumors, liver cancer, breast cancer, lymphoma, and others.
Despite all the obstacles placed on Social Security Disability applicants who suffer from cancer, —if you have been denied benefits– you should not be discouraged. It is estimated that approximately 70% of the initial applications for disability are turned down. However, your chances of success greatly increase once you hire a lawyer in the appeal process.
If you are applying for Social Security Disability benefits, having a lawyer on your side who has a good knowledge of the law greatly improves your chances of getting your case approved.
At Ramos Law, we know how to use Social Security Disability laws to win benefits for our clients. Not only do we know how to use the law to your advantage, we win more for you because we put our heart into what we do.
